Velocity Express (n/k/a MCTS2) Files Numerous Preference Complaints in Delaware Bankruptcy Court

MCTS2, which was formerly known as Velocity Express, Inc., has filed over 75 adversary complaints this week in the Delaware bankruptcy court.  Velocity Express, which is one of the affiliated debtors in the VEC Liquidating Corporation chapter 11 cases, seeks avoidance and recovery of allegedly preferential transfers in each of the complaints.  In addition, the complaints also seek disallowance of the defendants' claims against Velocity Express pursuant to sections 502(d) and (j) of the Bankruptcy Code.  The complaints also allege that Velocity Express demanded voluntary return of the transfers early in 2011 in at least some of the cases, but the defendants refused the debtor's request.
